More elaboration on this:

"Ghost guns" have allegedly increased so dramatically in the last couple years because of how the ATF categorizes guns recovered at crime scenes. What changed you ask? They now include guns where the serial number has been filed off, which criminals have been doing for fucking ever. Also, the ATF report and "Ghost gun" bill says "SUSPECTED" ghost guns. So it has nothing to do with statistical fact.

What the law also does is redefines what a "firearm" is. 80% kits, which isn't a firearm because it's basically just a frame without all the mechanisms that actually make it a gun is now officially "a firearm". No trigger, slide, firing pin, etc. Just a piece of polymer is a firearm. And any firearm made with such a frame must be registered and given a serial number or...illegal. Do not pass go, go straight to jail. This applies to upper receivers for AR15's. Basically, they don't want anyone able to build their own gun at home without the ATF knowing everything. It's a government database, period.
 
and the point of these huge gov databases isn't going to be going after some mythical worst offender, its about selectively applying the law to punish political enemies. That's my main issue with more government control, they can't possibly follow up on every issue, they pick and chose. Then when government is focused on that shit, they're allowing violent cartel members to stroll across the border, violent offenders out of jail to murder people, etc. Fed gov needs to do a few things well (defense of borders, interstate transportation, as in the constitution) the rest should be handled by the states.

yeah I'm sure the surge in crime has nothing to do with the lack of prosecution of criminals and letting them out of jail early for covid, or the fact they all watched cities burn in 2020 with zero repercussions.

Everytime I see people complaining about ammo shortages and such on Youtube or other media areas, I just say that it's there if you know where to look. But I'm sure as shit not sharing it all with hundreds of thousands of people :lol:

Federal preemption.

The feds put the kibosh on suing gun makers and dealers about 20 years ago with the Protection of Lawful Commerce in Arms Act. The Sandy Hook parents got around it in the Connecticut state courts by claiming that Remington engaged in some kind of unlawful advertising, but that was a huge stretch and a very close call even in a jurisdiction that was already hostile to gun rights before Sandy Hook.

Preemption means that where Congress has passed legislation on a subject like this one, the states can't enforce their own, contrary laws.

That said, some state courts have been hostile to this particular law - in addition to Connecticut, there was a case in Pennsylvania that ruled the PLCAA was unconstitutional, which I think is still being reviewed by an en banc panel of the same appellate court. The Supreme Court refused to hear the Sandy Hook case and unless and until they do start hearing these cases, you can expect courts in some jurisdictions to find creative ways to get around the law.
