According to Gainesville Police Sgt. Art Adkins, an argument with the clerk broke out after the two were asked to pay for a bag of chips at Jimmy John's restaurant, 1724 W. University Ave.

"They became verbally abusive, struck the employee with empty soda cans and a sandwich, and then fled the store,'' Adkins said.

Carter and Cunningham were stopped by police across the street from campus, identified by the store employee, and arrested by GPD.

So either the employee had to change his mind, recant or the police were shitty in their investigation on the night in question? I hate not having more info in these situations.

the problem, IMO, is that the cop apparently arrested him despite the complaining witness saying J.Cunningham didn't do anything. Either that or the complaining witness changed his story (which is always sketchy).

I don't think any charges were justified.

I don't know much about the criminal system in FL...but to my understanding, we don't have grand juries to indict people. The cops arrest you, give you a preliminary charge, then the state attorney gets the file? and he makes the call whether to go forward? maybe someone can help me out with that. Doc? Hater?

If my thinking is right...either the cop screwed up on the arrest and prelim charge or theres dirty dealing/the witness is a pussy.

and if it were true for example that there WAS a conspiracy against student athletes and we all knew this to be fact, DON'T YOU THINK THE STUDENT ATHLETES THEMSELVES WOULD KNOW THIS TO BE THE CASE? if it is indeed the case, what the hell is he doing outside at 4AM jeopardizing his career, his teams success, and his coaches reputation. i almost wish there WAS a conspiracy so we can rip the young man a new asshole for being dumb and stupid.

some things classify as stupid and criminal.

Others classify as just stupid.

I said out the outset that this just classified, IMO, as stupid.

The state attorney is realizing this isn't worth the time and money to prosecute and dismissing it.

Should he be punished within the team? sure, and I'm sure in some form he will.

Should he deserve a criminal record over this? Not, IMO.

i hate individuals that are out for themselves and have less care for society....that's who i hate.

cunningham shouldn't be out at 4AM. he goes out at that time, he better be surrounding himself with others who have good judgment and have sensibilities. he shouldn't be hanging around guys who get mad at night clerks over potato chips...he shouldn't be hanging around guys who trouble "find" all the time.

in this case, we've got some individuals who are out at 4AM (nothing good happens past midnight by the way)...one a footballer who doesn't give a fuck about his team, his coach, his future...he only cares that he's able to go out at 4AM because he wants to...he's not looking at the big picture...his interests concern him and him alone...he cares not about the big picture...he cares not about society...he's a big "ME" guy and i say fuck him.

it's being reported that his punishment will be that he will not receive his bowl gift package. Included in such package was a $400 gift certificate to Best Buy and another to Panama Jack Sunglasses. Usually these bowls give out some VERY nice gifts. I think that's a pretty steep penalty for throwing a sandwhich at someone.

do you think the thin blue is a myth? as in, do you really think cops don't stick up for each other until the bitter end? If you answer those questions in the affirmative, we have rather divergent views on police. Because, in my experience, cops believe each other before they believe anyone not wearing that uniform. A cop "justifying" his actions can be rather simple, even when he has no truly just reason for his actions.
